Privacy Policy

  1. This Privacy Policy sets out the privacy and personal-data-processing rules for users of the Website, based on Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, p. 1) (“GDPR”) and applicable national personal-data legislation.
  2. The Website is operated by Nekera Sp. z o.o., a tour operator belonging to the Enter Air S.A. group, with its registered office in Warsaw, 00-695, ul. Nowogrodzka 49, NIP: 7010957111, KRS: 0000815830, REGON: 384937226. Nekera Sp. z o.o. is the controller of personal data collected, processed and used in connection with users’ use of the Website.
  3. The Website does not automatically collect any information or process any personal data, except for information contained in cookies.
  4. Cookies are IT data, in particular text files, stored on the Website User’s terminal device and intended for use with the Website. Cookies usually contain the name of the website from which they originate, their storage period on the terminal device and a unique number.
  5. We use two principal types of cookies on our Website: session cookies and persistent cookies. Session cookies are temporary files stored on the terminal device you use until you log out, leave the website or close the software (web browser). Persistent cookies are stored on the service recipient’s terminal device for the period specified in the cookie parameters or until they are deleted.
  6. Data in cookies are generally used to recognise a particular service recipient automatically by the server so that it can generate a page intended for that recipient. This may, for example, enable website customisation, login handling and statistics. In practice, stored cookies can allow the server to verify whether a vote in a poll was cast from a given computer. They can also tailor advertising on a website so it is not displayed repeatedly to the same service recipient. We use cookies to adapt the content of web pages to the preferences of the service recipient and to optimise use of the Website. The following types of cookies are used on the Website: a. “necessary” cookies, enabling use of services available on the Website, for example authentication cookies used for services requiring authentication on the Website; b. “performance” cookies, enabling collection of information about how Website pages are used; c. “advertising” cookies, enabling delivery of advertising content better suited to Users’ interests.
  8. In many cases, web-browsing software (a web browser) allows cookies to be stored on the User’s terminal device by default. Website Users may change their cookie settings at any time. In particular, those settings may be changed to block the automatic handling of cookies in browser settings or to notify the User whenever cookies are placed on their device.   9. Cookies placed on the Website User’s terminal device may also be used by advertisers and partners cooperating with the Website operator.

We do not make your data available to any other third parties other than as follows from the purpose of the Website’s activity and the scope of consents and statements given, unless there is a legal basis requiring such action. We make every effort to protect this information properly, in particular as provided for by personal-data-protection legislation and the legislation on providing services by electronic means. Personal data are transferred, on the basis of the relevant regulations or agreements, to public authorities authorised to process them within their statutory powers and to business partners in accordance with personal-data security requirements and the purposes of personal-data processing by the Controller described above.
  12. Your personal data are processed until consent to their processing is withdrawn.
  13. You have, among other things, the right to request access to your personal data, rectification or restriction of their processing, as well as the right to erasure. You may also withdraw consent to the processing of personal data if we received such consent from you and lodge an objection. If you wish to exercise your rights, please send your request by post.
  14. Right to confirmation of processing. You have the right to obtain confirmation from us as to whether your personal data are processed and, where that is the case, you are entitled to access the data and obtain information about the processing of your data.
  15. Right to rectification. You may request that we rectify your personal data without undue delay if you consider them inaccurate or out of date. You may also ask us to complete them if you consider that, in view of the purpose for which we process the data, they are incomplete.
  16. Right to erasure. You have the right to erasure. This means that you may request the deletion of your personal data and we will delete them without undue delay if the personal data are no longer necessary for the purposes for which we have the right to process them; we process the data on the basis of your consent and you have withdrawn that consent; you have objected to our processing; the data are processed unlawfully; erasure is necessary for compliance with a legal obligation under European Union law or the law of the Republic of Poland; or personal data were collected in connection with the offer of information-society services to a person under 18 years of age.
  17. Right to request restriction of processing. You may request that we restrict the processing of your data if you contest the accuracy of the personal data; you consider the processing unlawful but oppose their erasure; we no longer need the personal data for processing purposes but you need them for the establishment, exercise or defence of claims; or you have objected to our processing.
  18. Right to data portability. You may ask us to send you, in a structured, commonly used and machine-readable format, the personal data you previously provided to us. You may transmit those data to another controller and may also ask us, where technically feasible, to transmit them directly to another controller. The right to data portability applies only to data which we process on the basis of a contract with you or on the basis of your consent.
  19. Right to object. We process collected personal data for the purpose of direct marketing of our services; therefore, you have the right to object at any time to processing to the extent that it is carried out for direct-marketing purposes. In that case, we will cease processing your data for that purpose without undue delay.
  20. Right to withdraw consent. You may withdraw any consent you have given at any time. From the time you make such a request, we will no longer process data for the purpose indicated by you. Please remember, however, that until consent is withdrawn, we have the right to process your data.
  21. Right to lodge a complaint. You have the right to lodge a complaint concerning our actions or omissions with the President of the Personal Data Protection Office.

  23. Thulium messenger. We use the Thulium messenger on the Website. If you start a conversation in the messenger, we process the data you provide in the conversation and the technical data necessary to operate it, including information about the time of communication, IP address, and the device and browser used. We use this data solely to handle your enquiry, contact you about our services, ensure communication security, and protect against abuse. The messenger provider may process the data to the extent necessary to operate this service.
